Petitioner, who is in custody, seeks bail in connection with Rajauli P.S. Case No. 181 of 2018 registered for the offence punishable under Sections 341, 323, 325, 307, 379, 506/34 of the Indian Penal Code.

Petitioner had earlier moved this Court for regular bail vide Cr. Misc. No. 2131 of 2019 which was disposed of on 27.02.2019 with a direction that petitioner would be enlarged on bail after one year of custody by the court below itself. The petitioner had also moved for provisional bail, which was granted vide order dated 27.04.2019 and on expiry of period of provisional bail, he surrendered on 24.05.2019. It has been submitted on behalf of petitioner that

No.47621 of 2019(2) dt.07-08-2019 2/2 while he was on provisional bail, firing was made upon him, due to which he received firearm injury in arm pit and leg, as such he may be granted regular bail prior to completion of one year in custody as per order dated 27.02.2019 as contained in Annexure-1.

Considering the nature of allegation against petitioner, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected. (S. Kumar, J) veena/- U T
