The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354(B), 452, 380, 504 and 506 of the Indian Penal Code. It is a case of outraging the modesty of the informant by the petitioner. It is further alleged that during course of altercation between the informant and the petitioner, her Saree got undressed and she became half necked. So the prosecution story is apparent that the petitioner has not intentionally outraged the modesty of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that earlier too the husband of the informant had

No.60754 of 2021(2) dt.11-05-2022 2/2 filed a case but by the villagers got pacified the matter but the case is still pending and the informant started demanding money for getting the case bearing Bettiah Muffasil (Manuapol) P.S. Case No. 415 of 2016 concluded on the basis of compromise, which was not fulfilled by the petitioner, hence, this case has been lodged by the informant.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, District- West Champaran in connection with Bettiah (Muffasil) Manuapool P.S. Case No. 566 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
