JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioners are apprehending their arrest in connection with Sahebpur Kamal P.S.Case No. 145 of 2014 instituted under Sections 341, 323, 379, 506, 307 and 34 of the Indian Penal Code and Section 3(i) (x) of SC/ST Act. Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 7.6.2014 at about 6 P.M. accused Anuj Singh in drunken condition snatched the mobile and Rs. 300/- forcefully as rangdari from informant Subodh Das.When the informant complained before Panches he assaulted the informant. While neighbours came to save the informant, he along with father and son assaulted the mediators. It has been submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.455 of 2015 (4) dt.07-05-2015 2/2 omnibus and general allegation has been made. No specific injury has been attributed. It is further submitted that except one injury, all other injuries are simple in nature. It is also submitted that the occurrence is said to have taken place inside the house and no offence under Section 3((i)(X) is attributed. On behalf of the State it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Deo Priya Kumar, Judicial Magistrate, 1st Class, Begusarai in connection with Sahebpur Kamal P.S. Case No. 145/2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
