JUSTICE ARUN KUMAR ORAL ORDER 29-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 27.3.2018, seeks bail in Buniyadganj PS Case No. 115 of 2012 registered under Sections 341, 324, 307/34 of the IPC and Section 27 of the Arms Act. Learned Counsel for the petitioner submits that the informant has categorically stated in his statement that he was shot by three persons namely Dharmendra Kumar Singh, Ravindra Kumar Singh and Sajjan Kumar Singh and the petitioner is even not named in the FIR, he has been named by one Ram Blash Yadav in his confessional statement, another similarly situated co-accused Bilash Yadav has been granted bail by a coordinate Bench of this Court.
Having considered the said facts and circumstances, the petitioner, namely, Subhash Mandal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar Pandey, Judicial Magistrate, lst Class, Gaya in connection with Buniyadganj PS Case No. 115 of 2012.
