Having regard to the stand taken by learned counsel for the State that the Finance Department of the Government has rejected the proposal for making payment of the dues of the employees of the Banmankhi Sugar Mill, and that now the Sugar department proposes once again to take steps for leasing Banmankhi Sugar Mill to private entrepreneur and the payment to the petitioner and other workmen of the said Banmankhi Sugar Mill will be made from such funds from amount
Patna High Court CWJC No.19607 of 2010 (6) dt.07-07-2015 of lease that the department would receive from private entrepreneur, this writ application has to be disposed of with a direction to the authorities to ensure that issue of full and final payment of the petitioner and other workmen of Banmankhi Sugar Mill shall be considered and paid in full or on pro rata basis, as the case may be, strictly on the basis of date of employment/retirement of the petitioner vis-à-vis other employees.
With the aforementioned observation and direction, this application is disposed of.
