2. Petitioner seeks regular bail in connection with Chandauti P. S. Case No. 123/2019 in a case registered for the offences punishable under Sections 341, 323, 307, 325, 379, 504 of the Indian Penal Code to which Section 302 of the Indian Penal Code was added later on.

3. Prosecution case, in brief, is that on 16.05.2019 while informant was returning with his friend Ajit Kumar after attending marriage ceremony of one Sintu Kumar, all the F.I.R. named accused persons along with 10 unknown persons brutally assaulted them as a result of which both of them sustained injuries and during course of treatment, Ajit Kumar died.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.52744 of 2025(2) dt.19-09-2025 2/2 petitioner is not named in the F.I.R. and his name surfaced during course of investigation. There is no specific accusation of assault against this petitioner. He further submits that F.I.R. named accused persons have already been granted regular bail by co-ordinate Bench of this Hon'ble Court vide Annexure-2 series. Petitioner is in custody since 29.12.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Chandauti P.
