JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Petitioner is languishing in custody since 28.01.2013 in a case registered for the offences punishable under Sections 21, 22 of the N.D.P.S. Act.

The recovery is of 210 sachets of heroine.

It is submitted by learned counsel for the petitioner that exact weight of the seized contraband has not been mentioned in the F.I.R deliberately. The F.I.R reflects that seizure list was not prepared at the place of seizure. The status report of Superintendent of Police, Bhojpur, Ara has been submitted which suggests that five charge-sheet witnesses have already been examined. Considering the stage of the trial, this Court is not inclined to grant bail to the petitioner. Accordingly the application is dismissed in connection with N.D. Case No. 1 of 2013, arising out of Ara Rail
