No.201 of 2015 The interlocutory application has been filed seeking modification of the order dated 23.01.2015, by which cost of Rs.10,000/- was imposed on the State on the prayer of adjournment stating that it is the sixth time that the State is seeking time.
Learned A.A.G.II submits that the respondents tender unqualified and unconditional apology for the inconvenience caused to this Court.
It is stated that it was the first occasion on which the prayer for adjournment had been made on 23.1.2015 and the only other date the case was taken up was on 19.12.2014 when the State was directed to file its replies to the contents of the petition
Patna High Court Cr. WJC No.1205 of 2014 (7) dt.11-03-2015 and the case had been fixed for 21.01.2015.
On a consideration of the facts and circumstances of the case, the interlocutory application is allowed and the direction for payment of cost is recalled.
I.A. No.201 of 2015 is, accordingly, disposed of. Mr. Satish Kumar Sinha, learned counsel for the petitioner seeks permission to withdraw the application. The writ application is, accordingly, dismissed as withdrawn.
