JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Chandi P.S. Case No. 39 of 2019 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Amendment Act.

As per FIR there is recovery of huge quantity of liquor and other liquor manufacturing articles from the bank of river and petitioners are named in the FIR.

Submission of learned counsel for the petitioners is that they have been made accused on the basis of disclosure made by the villagers and there is nothing on record to show as to who has disclosed their names and for that case diary was

Patna High Court CR. MISC. No.49518 of 2019(3) dt.25-10-2019 2/2 called for.

Heard learned APP, who has opposed the prayer for anticipatory bail but could not point out as to who has disclosed the name of petitioners after verifying the case diary. In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV-cum-Special Judge, Excise Act, Bhojpur, in connection with Chandi P.S. Case No. 39 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
