Petitioner is in custody in connection with Amas P.S. Case No. 123 of 2019 for the offence under section 30(a), 56 (b) of Bihar Prohibition and Excise Act,2016. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Learned counsel for the petitioner further submits that recovery of the liquor was made from the pick up van and not from the possession of the petitioner.

In the instant case 560 liters of spirit country made wine was seized from the pick up van.

The petitioner is in custody since 15.6.2019. Considering the fact that petitioner has no criminal

No.47822 of 2019(2) dt.01-08-2019 2/2 antecedent and nothing was recovered from the possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judge Special Excise Act, Gaya, in connection with Amas P.S. Case No. 123 of 2019.
