JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Bhairab Asthan P.S. Case No. 06 of 2013 instituted under Sections 341, 323, 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that the informant was married with the petitioner in the year 2008. After marriage, she lived properly at her matrimonial house till some days. Thereafter, petitioner and other co-accused persons used to demand motorcycle as dowry, assault her and oust her from her matrimonial house.

It is submitted on behalf of the petitioner that the petitioner is the husband of the informant and he is ready to

Patna High Court Cr.Misc. No.49934 of 2014 (2) dt.08-05-2015 keep the informant as his wife with full dignity and honour and on the earlier occasion a similar case was instituted. He was keeping his wife, but the informant on her own had deserted the petitioner and this time also she has deserted the petitioner.

On behalf of the State it is submitted that the petitioner is named in the First Information Report and there is specific allegation against him.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani in connection with Bhairab Asthan P.S. Case No. 06 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

It is further direction that the petitioner shall deposit an amount of Rs. 1500/- per month before the learned court below, which shall be released in favour of the informant. (Sudhir Singh, J) P.K./- U T
