Petitioner seeks bail in Bhabua P.S. Case No.38 of 2019 instituted for the offence under Section(s) 363, 302, 201, 364/34 Indian Penal Code.

It is alleged in the written report that her husband went with daughter-in-law and grandson to purchase medicine. Later on, he did not return. The informant learnt that her daughter-in-law had gone to Maika with her son. The informant raised suspicion against daughter-in-law of kidnapping her husband because there was domestic dispute between the parties.

In the impugned order, it has come that name of the petitioner has come during investigation. Police recorded

Patna High Court CR. MISC. No.48635 of 2019(2) dt.08-08-2019 2/2 confessional statement of Baldau Singh @ Chotu Singh, who is brother of daughter-in-law of the informant. He in his confession disclosed name of Prabhat Kumar. Thereafter, police recorded confessional statement of Prabhat Kumar, who disclosed name of the petitioner.

In this manner, there is no specific overt act alleged against the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 13.05.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur, Bhabua, in connection with Bhabua P.S. Case No.38 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
