The petitioner is in custody in connection with R.P.F. Post Fatuha P.S. Case No. 01 of 2018 registered for the offences under Sections 3 of the R.P.(U.P.) Act.
Learned counsel for the petitioner submits that the allegation against this petitioner is that he was found to have stolen 17 numbers of Battery worth Rs. 26,434/-. The case was initially registered against unknown. However, the petitioner was apprehended after the occurrence but at the time of his arrest nothing was recovered from his possession which could incriminate the petitioner for commission of offence.
