In this case, the petitioner is only raising a grievance that construction of the electric pole has put hindrance in the flow of the water.

It has been submitted that it was the Aahar assisting the people of the locality in irrigating their agriculture field.

Patna High Court CWJC No.15336 of 2019 dt.23-08-2019 2/2 Counsel for the Bihar State Power Transmission Company has submitted that they have already erected the electricity pole in such a manner that it would not interfere with the flow of the water. It has further been submitted that the Aahar is on the paper, but it is no longer an Aahar and for the purpose of construction of the electricity pole, they have put the soil, but now they are intending to remove those soil, but the villagers are opposing for the same.

Counsel for the petitioner submits that in person he will not disturb for lifting the soil.

It goes without saying that while lifting the soil, the Bihar State Power Transmission Company will arrange in such a manner that it should be brought to the shape of Aahar and water should flow without any hindrance.
