JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2015 Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 409/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.14605 of 2015 (2) dt.12-05-2015 The petitioners being the Agriculture Coordinator, posted at Belhar Block alleged to have misappropriated Rs. 29,18,667/- with regard to Paddy Procurement Scheme.

It is submitted by the learned counsel for the petitioners that the petitioners shall get the 50% salary per month deducted towards the alleged misappropriated amount. Learned counsel for the State Food Corporation accepts offer of the petitioners.

Considering the present stand of the parties, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka in connection with Belhar P.S. Case No. 02 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.

The B.S.F.C. will be at liberty to file a petition for cancellation of bail bond of the petitioners, if the petitioners fail to comply the undertaking.
