The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 342, 379, 347, 504/34 of the Indian Penal Code 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

It is alleged that the accused persons forced the informant to catch fish from the pond on oppose being made he was abused by petitioner no.1 Manish Yadav @ Manish Kumar by calling caste name. The informant was subsequently assaulted and dragged. The accused persons took away 20 kg

Patna High Court Cr.Misc. No.50276 of 2014 (4) dt.27-04-2015 2/2 fishes from the pond.

It is submitted by learned counsel for the petitioners that no injury has been caused to the informant and for the occurrence of 11.01.2014, the complaint was filed on 17.01.2014 which came to register on 14.02.2014. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with SC/ST P.S. Case No.17 of 2014, pending before the learned Chief Judicial Magistrate, Araria.

With the above observation, this application is, accordingly, disposed off.
