The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366(A) read with 34 of the Indian Penal Code.
As per the prosecution case, the daughter of the informant had gone to her friend but she did not return till noon. The informant started searching her but she was not found. In the course of search, the informant came to know that his daughter's classmate Babita, her husband Santosh Kumar, the
Patna High Court CR. MISC. No.50599 of 2022(2) dt.12-12-2022 2/2 petitioner and his mother and father have kidnapped the informant's daughter who is minor and aged about 16 years. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The victim in her statement recorded under section 164 of Cr.P.C. did not support the prosecution case. The charge-sheet has already been submitted. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.01.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Khagaria P.S. Case No. 14 of 2022.
The application stands allowed.
