ANJANA MISHRA ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.01.2018 in connection with Babubarhi P.S. Case No.201 of 2017, G.R. No.1757/2017, registered for the offence under Sections 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire case against the petitioner is false and motivated and the allegation that the petitioner had not handed over the charge with regard to the repair and expenditure of the repaired solar lights between the year 2010 and 2014 is wholly misconceived. It is further submitted that the petitioner had already submitted his
Patna High Court Cr.Misc. No.32942 of 2018 (3) dt.04-07-2018 2/2 charge and whatever solar lights were repaired had been duly accounted for by the present petitioner, but the Panchayat Sachiv of Babubarahi Block had mischievously communicated that the petitioner had not handed over the charge and under such circumstances, the petitioner has been taken into custody. Having heard learned counsel for the petitioner and the learned counsel for the State and considering the entire facts and circumstances and also because the investigation of the case has been completed, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Madhubani, in connection with Babubarhi P.S. Case No.201 of 2017, G.R. No.1757/2017.
