The petitioner seeks bail in connection with Sahar P.S. Case No. 135 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.
The allegation is regarding the accused persons having stolen a tractor.
The learned counsel for the petitioner submits that neither any incriminating article has been recovered from the possession of the petitioner nor any T.I. Parade has been held. It is further submitted that the petitioner is languishing in custody since 15.11.2017 and similarly situated co-accused persons have been granted bail.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.32049 of 2018 (3) dt.19-07-2018 2/2 case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Bhojpur at Ara in connection with Sahar P.S. Case No. 135 of 2017.
