The petitioner seeks bail in connection with Benipatti G.O. Case No. 260 of 2021, dated 03.09.2021, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He was an occupant of a three-wheeler from where 225 litres of liquor is said to have been recovered. It has been submitted on behalf of the petitioner that he was a bona-fide passenger in that vehicle and was going to appear in an examination.

The petitioner is in custody since 03.09.2021.

Patna High Court CR. MISC. No.60520 of 2021(2) dt.23-05-2022 2/2 Regard being had to the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise Act, Madhubani in connection with Benipatti G.O. Case No. 260 of 2021.

The application stands allowed.
