The petitioner being the father-in-law of the victim is apprehending his arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant. The victim was assaulted and caused several injuries and was thrown on the side of the road when the victim was being taken to hospital by informant she died on the way.
It is submitted by the learned counsel for the petitioner that accusation of assault is omnibus and general. The post-mortem report does not suggest any external or internal injury. The cause of death has not
Patna High Court Cr.Misc. No.10261 of 2015 (2) dt.12-03-2015 been ascertained. The husband of the victim is in custody. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Samastipur in connection with Musarigharari P.S. Case No. 129 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
