The petitioner apprehends his arrest in Kudhani (Turki OP) P.S. Case No. 95 of 2022, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. 26.250 litres of foreign liquor has been recovered from the bamboo clump behind the house of this petitioner. It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public. Counsel for the State vehemently opposed the bail application and submitted that petitioner has got criminal antecedent of similar nature.
