JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Joki Hat P.S.Case No. 157 of 2014 instituted under Sections 467, 468, 471, 420, 504 and 506 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner who is an agent persuaded the informant and several others to have opened their accounts and invested money with the company, namely, Agro Farming Pvt. Ltd. India and also promised to pay their money in case the company disappear. It has been submitted on behalf of the petitioner that he has no criminal antecedent. It is also submitted that , in fact, he has falsely been implicated in the present case. He has further

Patna High Court Cr.Misc. No.49194 of 2014 (3) dt.08-05-2015 2/2 been submitted that he is merely an employee of the said company which he assured common people to return the said money with high rate of interest. It is also submitted that the petitioner had no wrongful game for himself.

On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Joki Hat P.S.Case No. 157 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. It is further directed that the petitioner shall deposit an amount of Rs. 25,000/- (twenty five thousand) in the court below, which shall be subject matter of final disposal of the case.
