The petitioner seeks regular bail in connection with Special Case No. 2670 of 2018 arising out of Didarganj P.S. Case No.45 of 2018 for the offences punishable under Section(s) 30(a) of the Bihar Prohibition of Liquor and Excise Act, 2016. The allegation is regarding the recovery of 31 liters of illicit liquor from the tempo used for carrying passengers. The learned counsel for the petitioner submits that the petitioner is innocent and nothing has been recovered from the conscious possession of the petitioner and the petitioner is neither owner nor the driver of the said tempo. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 22.03.2018.
