JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Shankarpur P.S. Case No. 25 of 2019 registered for the offences punishable under Sections 406, 408, 409, 420 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he committed irregularity in the PCC work, who happens to be Junior Engineer.

Submission of learned counsel for the petitioner is that there is irregularity in the supply of the articles and for that he is not responsible and later on after demolishing the road he got the road reconstructed.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.48719 of 2019(3) dt.16-11-2019 2/2 petitioner surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Madhepura, in connection with Shankarpur P.S. Case No. 25 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation as well as in the departmental inquiry, if any, pending against him.
