Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhore P.S. Case No. 301 of 2022 lodged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, Amendment Act, 2018, 2022.

As per prosecution case, total 432 liters of foreign liquor have been recovered in this case.

Learned counsel for the petitioner submits that petitioner is innocent and he has committed no offence. He further submits that petitioner was the passenger of the vehicle on which the said recovery was alleged to be made and this

Patna High Court CR. MISC. No.50552 of 2022(2) dt.11-11-2022 2/2 vehicle has been driven by some other accused person. He further submits that antecedent of the petitioner is clean and he is in custody since 29.06.2022.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-II-cum- Special Excise Court-I, Gopalganj in connection with Bhore P.S. Case No. 301 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
