Mr. Anil Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 11-08-2025 Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 51 of 2025 registered for the offence under Sections 21, 22 of the NDPS Act.

3. The recovery is of 29 bottles of Codeine Phosphate & Triprolidine Hydrochloride Eskuf Syrup, each bottle of 100ml, (total quantity 2.900 litres) and Nitcor-10 tablets, total 300 pieces, were recovered from the petitioner who is in custody since 24.04.2025.

4. This application is disposed of with direction to the Principal District and Sessions Judge, Araria to explain to the petitioner/accused the fact that the recovery is of small quantity

Patna High Court CR. MISC. No.49277 of 2025(2) dt.11-08-2025 2/2 and the maximum punishment is one year and if he pleads guilty, he may be let off after completing a particular period in custody. If the petitioner pleads guilty, appropriate order shall be passed by the Court below.

5. In case, the petitioner does not plead guilty, the petitioner shall be released on bail by the Principal District and Sessions Judge, Araria.

6. While releasing the petitioner on bail, the Court below shall verify the fact whether the petitioner has clean antecedent or not. If it is found that the petitioner has clean antecedent then only he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS Act, Araria/concerned Court below in connection with Jogbani P.S. Case No. 51 of 2025.

7. This application stands disposed of with the aforesaid directions.
