2. The petitioner has challenged the appointment of private respondent no. 8 on the post of Aanganwari Sevika at the concerned Aanganwari centre in the district of Madhubani on the ground that the private respondent no. 8 was placed below the petitioner in merit list and her

Patna High Court CWJC No.14997 of 2019 dt.31-07-2019 2/3 claim for such post is based on forged and fabricated educational certificates.

3. A complaint was made by the petitioner before the CDPO and the District Programme Officer of the concerned ICDS centre but till date no decision has been taken as yet.

4. The petitioner under the aforesaid circumstances is directed to file a fresh complaint before the Child Development Project Officer, Kaluahi, Madhubani (respondent no. 6) within a period of three weeks from today, who, on receipt of such complaint shall after necessary verification and hearing the parties pass orders in accordance with law within a period of 30 days.

5. If no such order shall be passed by the C.D.P.O. within the aforesaid period, the case of the petitioner shall stand automatically transferred to the office of the District Programme Officer who shall take a decision in accordance with law. Should the petitioner remain aggrieved even thereafter, she would have the avenue of

6. The aforesaid process has been referred to in view of the provisions contained in the new guidelines of 2019.

7. With the aforesaid direction/observation, the writ petition is disposed of.
