The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 325, 380, 307/34 of the Indian Penal Code. The prosecution case is that on 22.10.2015 at 8.15 P.M. in the night the informant was in his shop. In the meantime crowd were going for immersing the idols. Suddenly, Ashok Kumar, Lav Kumar @ Law and Shankar Kumar and 3-4 persons entered into the shop of the informant and started assaulting the informant and they took away Rs. 10,000/- to 11,000/- from his cash box. When staff of the informant made protest, he was also abused by them.
It is submitted by the learned counsel for the petitioner that accusation is omnibus and general. The
Patna High Court Cr.Misc. No.14994 of 2016 (2) dt.11-04-2016 injury has been found to be simple in nature. Considering the accusation against the mob and coupled with the statement made in para-3 of the petition that petition has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kadamkuan P.S. Case No. 520 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
