JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Hathuwa P.S. Case No. 55 of 2018, dated 01.04.2018, instituted for the offences punishable under Sections 406, 341, 323, 324, 504 and 34 of the Indian Penal Code.
The petitioner is alleged to have inflicted a knife blow on the head of the informant at the time when he along with his brother had gone to ask the petitioner as to why his brother had not been sent abroad despite his having paid Rs. 1,50,000/-.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.31386 of 2018 (3) dt.28-06-2018 2/2 that a vague allegation has been levelled against the petitioner. No details of the payment of money has been provided in the F.I.R. In what connection, the money was paid is also not known. The reason for lodging the F.I.R. is an old enmity as the petitioner and the informant hail from the same village and are agnates also.
Regard being had to the nature of accusation and the fact that the petitioner does not have any criminal antecedent, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, he is directed to be released on anticipatory bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Hathuwa P.S.
