JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Panjwara P.S. Case No. 95 of 2018, disclosing offences under Sections 392/34 of IPC.

Prosecution story in short is that while the informant, being Manager of Bharat Finance Inclusion Limited was going to deposit the amount, two miscreants intercepted him and on the point of pistol, snatched the amount of Rs.1,22,542/- as well as some cash and two mobiles. It further appears that name of the petitioner transpired in the confessional statement of the coaccused. Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him and he has no criminal antecedent. Heard learned A.P.P. also, who has opposed the prayer

Patna High Court CR. MISC. No.48680 of 2019(2) dt.05-08-2019 2/2 for anticipatory bail on the ground that investigation is still going on.

Having heard both sides, in view of the facts, as stated above and also as investigation is still going on, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
