JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-08-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.
This is the fourth attempt of the petitioner to obtain bail in the present case in connection with Sessions Trial No. 404 of 2015 arising out of Naya Gaon P.S. Case No. 111 of 2013 for the offences registered under Section 364 A, 201 B, 212 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected by learned Predecessor Bench of this Court vide order dated 6.12.2016 and 31.1.2018 in Cr. Misc Nos. 46770 of 2016 and 1829 of 2018. Learned counsel for the petitioner has placed this application on the solitary ground that the petitioner has remained in
Patna High Court CR. MISC. No.7890 of 2021(4) dt.05-08-2021 2/3 custody in connection with this case for about seven years but the trial is yet not concluded. This Court has been informed that out of 59 witnesses till date 30 witnesses have only been examined. Learned APP for the State has opposed the prayer for bail of the petitioner.
It is stated that this case is not a simple case of abduction rather the perusal of the prosecution case would show that the victim Suhail Hingora was abducted by an interstate gang of kidnapper for ransom, this petitioner is one of them and in course of trial so far materials have come to support that the victim Sohail Hingora was confined in the house of this petitioner and he was seen in the house of the petitioner during the solemnization of marriage of the petitioner and he has been seen in the video footage. Learned counsel for the petitioner is in possession of a copy of deposition of Suhail Hingora, she has read out the statements made by this witness in course of trial. He has named this petitioner in his deposition and has stated that he was confined in the house of this petitioner after he was abducted by the interstate gang.
Considering the facts and circumstances of the case, the gravity of the offences alleged and the materials on the record as also keeping in mind that such offence if proved may invite severe punishment of death or imprisonment for life, this Court is not inclined to release the petitioner on bail at this stage.

No.7890 of 2021(4) dt.05-08-2021 3/3 difficult but it is expected that as soon as the normalcy is restored and the court starts functioning physically this case be fixed on 'day to day' basis and considering the gravity of the offences alleged, the public prosecutor must produce all the witnesses on the date fixed in the matter. All endeavors be made to conclude the trial as early as possible.
