1. Heard learned counsel appearing on behalf of the petitioners and learned Additional Public Prosecutor appearing on behalf of the State.

2. The both accused/petitioners are named in F.I.R. and apprehending their arrest in connection with Kumarkhand (Belari O.P.) P.S. Case No. 12 of 2023, registered for the offences punishable under Sections 341, 323, 379, 354-B, 327, 384, 504, 506/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioners submitted that alleged occurrence took place

Patna High Court CR. MISC. No.53206 of 2024(2) dt.28-08-2024 2/3 out of land dispute, where from the bare perusal of the FIR, allegation as raised against these petitioners is appearing very much general and omnibus alongwith other 14 named co-accused persons. It is submitted that even the face of FIR itself, suggest the land dispute between the parties. It is submitted that petitioners are men of clean antecedents.

4. Learned APP opposes the prayer of bail.

Considering the aforesaid facts and circumstances and by taking note of nature of allegation, which is appearing very much general and omnibus qua both above-named petitioners who are men of clean antecedents, accordingly, both above named petitioners, in the event of their arrest or surrender before the learned trial Court, within a period of four weeks of the order, are directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Madhepura/concerned

Patna High Court CR. MISC. No.53206 of 2024(2) dt.28-08-2024 3/3 Court, where the case is pending in connection with Kumarkhand (Belari O.P.) P.S. Case No. 12 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
