JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Araria P.S. Case No. 174 of 2018 dated 29.03.2018 instituted for the offences under Sections 341, 323, 354, 379, 385, 386, 504, 506, 34 of the Indian Penal Code.
The father of the informant had purchased a plot of land over which the informant had got collected sand, bricks, stone-chips and other building materials. Later, it was found that the aforesaid building materials were stolen. When she protested, one of the co-accused persons demanded protection money.
The learned counsel for the petitioners has submitted
Patna High Court Cr.Misc. No.32764 of 2018 (2) dt.02-07-2018 2/2 that petitioner No. 1 is the owner of the land in question and either by mistake or maliciously, the same land has been sold by the vendor to the father of the informant. The allegation of demand of money appears to be added for giving a serious colour to the occurrence.
Regard being had that there is a dispute over the possession of a plot of land and the matter was also to be looked into by the Sarpanch of the Gram Panchayat, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 174 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
