The petitioner apprehends his arrest in Supaul P.S. Case No. 428 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant made allegation that while he was constructing the boundary wall Rajkumar Singh and Manish Kumar Singh assaulted his father Vinay Kumar Singh with knife and sword. Ashok Kumar Singh the petitioner and others are alleged to have assaulted the informant Saurabh Kumar Singh and his uncle Rajeshwar Prasad Singh.
Learned counsel for the petitioner submits that the petitioner is own cousin of the informant. Rajkumar Singh is also own cousin of the informant. There is a series of litigation
Patna High Court Cr.Misc. No.7112 of 2015 (2) dt.20-02-2015 2/2 between the parties on account of land dispute and partition for the family property. It is further submitted that the informant and Rajeshwar Prasad Singh did not get any injury. Considering the facts aforesaid and the fact that the petitioner is alleged to have assaulted the informant and Rajeshwar Prasad Singh, but no injury was found on their person, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 428 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
