The petitioner apprehends his arrest in connection with Belhar P.S. Case No. 95/14 registered for the offences punishable under Sections 498-A, 323/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Earlier vide order dated 23.2.2015 notices have been issued to opposite party No. 2. After receipt of notice, opposite party No. 2 has appeared through Vakalatnama filed by one Mr. Madheshwar Singh, Advocate, who is not present to oppose the present application.
Considering the nature of allegations and also the fact that the petitioner is willing and ready to keep his wife with full
Patna High Court Cr.Misc. No.6987 of 2015 (3) dt.27-04-2015 honour and dignity, let the order dated 23.02.2015 be confirmed as the petitioner in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Banka in connection with Belhar P.S. Case No. 95/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. If, however, there is recurrence of any act which would amount to mental torture, it will be open to the opposite party no. 2 to seek appropriate remedy.
