Petitioners, in the present case, are seeking regular bail in connection with Gardanibagh P.S. Case No.93 of 2018, GR. No.1707/2018 for the offence punishable under Sections 420, 417 and 120 (B) of the Indian Penal Code.
Learned counsel for the petitioners submits that the allegations against the petitioners are that they had been impersonating some of the applicants helping them out in getting selected in physical test for appointment on the post of constable. It is alleged that they were arrested because their left thumb
Patna High Court Cr.Misc. No.32425 of 2018 (2) dt.13-06-2018 2/2 impression did not match with the thumb impression of the candidate who appeared in the written examination. Learned counsel for the petitioners submits that the petitioners are in custody since 12.03.2018 and similarly situated co-accused persons Binay Kumar and Rajnish Kumar have been granted bail by a Coordinate Bench of this Court vide order dated 07.05.2018 passed in Criminal Miscellaneous No. 27659 of 2018. Learned APP for the State is present.
Considering the facts and circumstance of the case and that the petitioners have remained in custody for three months and similarly situated accused persons have been granted bail by a Coordinate Bench of this Court, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Gardanibagh P.S. Case No.93 of 2018, GR. No.1707/2018 subject to the conditions as laid down under Section 437(3) Cr.P.C.
