====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-07-2026 Heard learned counsel appearing on behalf of the petitioner and learned counsels for the respondents.

The petitioners in paragraph no. 1 of the present writ petition have sought, inter alia, the following relief(s), which is reproduced hereinafter:- "That this is an application for issuance of appropriate writ, order or direction to the respondents to pay the amount of Provident Fund since 1/10/2018 to till today and amount of group insurance with penal interest at the rate of 18% per annum and for grant of pension which is due and for grant of all consequential benefits."

3. Considering the relief as prayed for in the present

Patna High Court CWJC No.11749 of 2025(4) dt.23-07-2026 2/3 writ petition, the respondents no.2 and 3, Commissioner, Provident Fund Office, Patna and Provident Fund Officer, Karmchari Bhavishya Nidhi Santha, Patna are directed to take appropriate steps by approaching the concerned organization for redressal of the petitioners' grievance, as they have not taken any action for technical lapses on part of the M/s Ravi Kant Kaushal Security Agency and M/s Kuldeep Singh Security Agency, by whom, according to the respondents, the petitioners were engaged as Guard in Indian Oil Corporation and Hindustan Oil Petroleum respectively and for the said reason, the petitioners have been harassed for non-payment of employee provident fund, pension and other admissible dues.

4. I find that the sole responsibility rests on the employer of the petitioners and respondents no.2 and 3. In case, the respondents no.2 and 3 find it proper to take action against the employer of the petitioners, they must immediately take in accordance with the provision of Employees' Provident Funds and Miscellaneous Provisions Act, 1952. In any case, the petitioners must be paid due amount within a period of six weeks.

5. In case of any laches on part of any of the respondents, the petitioners would be at liberty to take action

6. The writ petition is, accordingly, disposed of.
