Mr. Lalan Kumar, learned counsel for the petitioner, referring to the order passed by the District Teachers Employment Appellate Authority, submits that once the tribunal has held out that the appointment was not in accordance with law and as such it was agreed that the authorities will take steps for fresh recruitment in accordance with rules, the petitioner is entitled even in terms of the amended Rule, 2012 and due to the indifferent attitude of the respondents, the selection process was not undertaken and as a result thereof the petitioner has not been

Patna High Court CWJC No.5657 of 2016(2) dt.02-04-2018 2/2 provided with opportunity to participate in the selection process. In view of the above, the writ petition is disposed of with a direction to the respondent, District Education Officer and the District Programme Officer, Katihar to take steps for filling up the post at the earliest so that in the selection process the petitioner's case may be considered, if he is otherwise eligible. The entire exercise must be taken by the respondents within a maximum period of six months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
