The petitioner apprehends his arrest in connection with Saharsa Sadar P.S. Case no. 390 of 2019, registered under Sections 341, 323, 307, 504, 506, 427, 379, 384 and 386/34 of the Indian Penal Code.

The accusation is that informant Amrendra Kumar Singh after purchasing the land in Mohalla-Kailashpuri used to reside after construction of the house, due to hike in the price of the land, Shiva Prasad Yadav, Karuna Kumari, Ravi Yadav and son in law of Siva Prasad Yadav started to harass the informant and his family members so that informant left the house regarding the said incident, the informant had given

Patna High Court CR. MISC. No.47183 of 2019(2) dt.30-07-2019 2/3 written application to S.P., D.M. and SDO, Saharsa. In the morning of 01.05.2019, they came with JCB machine near the house of the informant and ordered to demolish his house, when informant made protest then Ravi Yadav made firing, but it did not hit him. Thereafter, all entered in the house of informant and took certificates and NSE and also caused assault to him through fist and slaps. At that time, they asked to the informant why ranshom of Rs.Two Lakhs was not paid to them.

Learned counsel for the petitioner submits that the informant constructed house on the land, which was sold by the grand father-in-law of the petitioner and the remaining land is in possession of the petitioner and his father-in-law Shiva Prasad Yadav, but eight feet land, which was left for passage was being encroached by the informant due to that reasons, hot talks were exchanged between the parties, but with ulterior motive, the informant lodged the present case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail
