JUSTICE RAMESH KUMAR DATTA) 26-06-2015 Learned counsel for the petitioner submits that appeal was dismissed due to non-compliance of the peremptory order dated 11.1.2011 in which the delay in compliance was only of two days in filing requisites of notices.

On a consideration of the facts and circumstances of the case, LPA No. 1852 of 2010 is directed to be restored to its original file.

The restoration application is, accordingly, allowed. Office is directed to accept the requisites of notices and issue notices forthwith.
