A counter affidavit is filed on behalf of the respondent nos. 3 to 6.
The petitioner served the government as Panchayat Sewak and superannuated from service with effect from 30.04.2008. The writ application prays for payment of diverse post retiral dues including the benefit of ACP.
The counsel for the petitioner on going through the counter affidavit has stated that the claim of the petitioner for grant of ACP having been rejected by the respondents he would
Patna High Court CWJC No.21513 of 2014 (2) dt.20-08-2016 2/2 seek permission of the Court to assail the said decision of the respondent before appropriate authority/ forum in accordance with the law. The said claim is not considered.
It has been stated that the other dues of the petitioner under the diverse heads of retiral benefits, have been paid but the respondents have not paid the interest including the payment under the head GPF. He, therefore, seeks liberty of this Court to approach the concerned respondent(s) for payment of the statutory interest over the retiral dues payable to the petitioner. This court permits the petitioner to make such representation for consideration and disposal in accordance with the law. The writ application is disposed of with an observation that if any such claim before the appropriate authority is filed, the same shall be examined in accordance with the law as quickly as possible preferably within two months of such representation/filing along with a copy of this order.
