The petitioner seeks regular bail in connection with Barauni P.S. Case No. 468 of 2017, registered for the offences punishable under Sections 386/34 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act.
The allegation is regarding the accused persons having tried to commit untoward incident in a shop and having tried to extract extortion money, whereafter, though the rest of the accused fled away but the petitioner was caught by the local people and one country made pistol was recovered from the petitioner.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and
Patna High Court Cr.Misc. No.32217 of 2018(3) dt.19-07-2018 2/2 barring one case, he is having a fair antecedent and in the said case, the petitioner is on bail. It is further submitted that the petitioner is languishing in custody since 06.12.2017. Having regard to the facts and circumstances of the case, it is directed that the petitioner be released on bail immediately upon completion of six months of custody and in case, he has already completed six months of custody, he shall be released immediately subject to such conditions as may be imposed by the Judicial Magistrate, 1st Class, Begusarai in connection with Barauni P.S. Case No. 468 of 2017.
The present petition is disposed of.
