The learned counsel for the petitioner submits that the instant writ application has been filed seeking a writ of mandamus for a direction upon the respondents to provide security to the petitioner for making boundary wall on her land at Mauja-Siwan Naya Kila, Thana-231, Ward No. 7/5, Holding no. 405/470 Area 2.5 Dhur.

3. The learned counsel submits that he had also

Patna High Court CWJC No.18553 of 2021(3) dt.18-11-2024 2/3 represented before SDO, Siwan seeking redressal of his grievance as the lumpen element of the area were not allowing him to construct the boundary when he has all the documents relating to the land showing his right and title.

It is submitted that from perusal of Annexure-8, it would manifest that the Circle Officer, Siwan Sadar vide his letter no. 1210 dated 20.08.2020 addressed to the SDO, Siwan Sadar had requested for providing force for getting the boundary constructed. It is next submitted that from the perusal of Annexure-9, it would manifest that the same is the letter of the SDO, Siwan Sadar contained in letter no.1525 dated 16.09.2020 addressed to the Circle Officer, Siwan Sadar and Officer Incharge Town P.S Siwan wherein he has directed the aforesaid authorities to ensure that if any untoward occurrence takes place in that event to take appropriate action in accordance with law.

At this stage the learned AAG submits that the grievance of the petitioner shall stand redressed if the petitioner files a fresh application before SDO with all the documents relating to land showing his right and title, on which the learned counsel appearing on behalf of petitioner submits that he will file an application on or before 28.11.2024 before the SDO for providing police force after depositing the requisite amount

Considering the submissions made by the learned counsel for the parties the writ application is disposed of with a direction to the SDO to dispose of the representation of the petitioner filed on or before 28.11.2024 in accordance with law, within a period of three weeks from the date of receipt of the representation of the petitioner.
