JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-04-2016 Heard learned Counsel for the petitioner, and learned Additional Public Prosecutor for the State. Seen the contents of the present application seeking modification of the part of the order, dated 30.07.2015, passed in Criminal Misc. No. 51913 of 2014, whereby, while granting provisional anticipatory bail, for a period of six months, this Court had directed the petitioner to surrender before the Court, whereafter he shall be taken into custody.

Considering the peculiar facts and circumstances, it is directed that if the petitioner surrenders before the Court below within a period of four weeks from today and seeks regular bail, if so advised. If he does so, the Court below will not be required to take him into

Patna High Court Cr.Misc. No.13749 of 2016 (2) dt.08-04-2016 2/2 custody and consider his application for regular bail and dispose it of on the same date.

This Court expects that the Court below shall take into account the health condition of the petitioner while disposing of his application for regular bail. This application is allowed to the extent indicated above and accordingly the order, dated 30.07.2015, passed by this Court in Criminal Misc. No. 51913 of 2014 stands modified.
