JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.07.2017 passed in Cr. Misc. No. 27814 of 2017 along with Cr. Misc. No. 30796 of 2017 with an observation to conclude the trial within a period of nine months. Submission of learned counsel for the petitioner is that till now only three witnesses have been examined and all of them have been declared hostile and petitioner has named as accused on the basis of last seen.

Heard learned A.P.P also.

Having heard both sides and in the facts and circumstances, as stated above, considering the period of custody and petitioner is in custody for more than one year, let the petitioner, named above, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.32981 of 2018 (2) dt.22-06-2018 2/2 bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Katihar, in connection with Sessions Trial No. 153 of 2017 arising out of Barari P.S. Case No. 331 of 2016, on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that the petitioner shall co-operate in disposal of the trial.
