====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-05-2015 Learned counsel for the petitioners submits that the petitioners no. 1 and 3, namely, Amar Kishore Singh and Shashi Singh have already been arrested.
Accordingly, the Anticipatory Bail Petition of the above named petitioners no. 1 and 3 is dismissed as having become infructuous.
Heard both sides.
The petitioners no. 2 and 4, namely, Umeshwar Singh and Sanjay Singh apprehend their arrest in a case under Section 436 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
Kameshwar Mahto, the informant, made allegation of
Patna High Court Cr.Misc. No.16855 of 2015 (2) dt.15-05-2015 2/2 assault against the petitioners. It is alleged that Ram Pravesh Singh and Amar Kishore Singh set ablaze the house of the informant in which the household articles were burnt to ashes. Submission is that there is no specific allegation against the petitioners no. 2 and
4. Specific allegation of setting ablaze the house is against Ram Pravesh Singh and Amar Kishore Singh, who have already been enlarged on bail.
Considering the facts aforesaid, the above named petitioners no. 2 and 4, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in Turkauliya (Banjariya) P.S. Case No. 451/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
