The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and sections 25 (1-B)(a), 26 and 35 of the Arms Act.
As per the prosecution case, a country-made pistol, one live cartridge and one motorcycle were recovered from the possession of the petitioner who was apprehended by the police on secret information.

Nothing has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is the bonafide owner of the motorcycle seized by the police. The petitioner is accused in two other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 05.01.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali in connection with Lalganj P.S. Case No. 09 of 2022.
The application stands allowed.
