2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 317 ( 4 ), 317 (5) , 338 , 336 (3) , 340 ( 2 ) and 3(5) of BNS.

The prosecution case in brief, is that on the alleged date and time of occurrence , upon secret information , a raid was conducted by informant and others and 3 accused persons were apprehended with stolen motorcycle , one knife , one lock breaking iron rod, one amplifier, five red colour sarees and cloth of pant-shirt kept in a box and two maroon and two red coloured sarees kept in a box were recovered and apprehended persons disclosed the name of this petitioner as one of their associates.

4. It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.50393 of 2025(2) dt.19-08-2025 2/2 petitioner is innocent and has committed no offence as alleged. The name of the petitioner transpired during course of investigation in the confessional statement of apprehended coaccused persons. No incriminating article has been recovered from possession of petitioner. Except confessional statement there is nothing on record to substantiate the complicity of this petitioner in the present case .

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Maistrate - 1st Class, Motihari East Champaran in connection with Pirprakothi P.S. Case No. 65 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
