JUSTICE PARTHA SARTHY ORAL ORDER 20-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Chakmehsi P.S. Case no. 12 of 2020 registered under section 392 of the Indian Penal Code. As per allegation in the F.I.R., it is stated by the informant who works in a financial insurance company that four accused persons armed with pistol entered his office premises and on the point of pistol looted Rs.17.35 lacs besides other articles. It is further stated that the CCTV camera was not working. He gives a description of the accused persons.

It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in course of investigation on the confessional statement of co-accused Md. Kaisar made before police. The said Md. Kaisar was enlarged on bail vide order dated 22.6.2021

Patna High Court CR. MISC. No.8924 of 2021(4) dt.20-07-2021 2/2 passed in Cr. Misc. No.5297 of 2021. No incriminating article has been recovered from the petitioner's possession. The petitioner has not been put on T.I. parade inspite of being in custody since 25.8.2020. Investigation in the case has concluded. The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner has three cases pending against him from before.

Having heard learned counsel for the parties and in the facts and circumstances of the case including grant of bail to Md. Kaisar on whose confessional statement the name of the petitioner transpired, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Chakmehsi P.S. Case no. 12 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate I, Samastipur.
